Terms of service
This page (together with our Privacy Policy) tells you information about us and the legal terms and conditions (“Terms”) on which we sell any of the products listed on the Oxford Oratory’s Online Shop (“Products”) — shop.oxfordoratory.org.uk (“Site”) — to you. This website is operated by the Oxford Oratory of St Philip Neri (“the Oxford Oratory”). Throughout the site, the terms “we”, “us” and “our” refer to the Oxford Oratory.
These Terms will apply to any contract between us for the sale of Products to you (the “Contract”) made using our Site. Please read these Terms carefully and make sure that you understand them, before ordering any Products from our Site. If you refuse to accept these Terms, you will not be able to order any Products from our Site. If you think that there is a mistake in these Terms, please contact us to discuss. By completing the order process, you signify your agreement to be bound by these Terms.

Contract
We invite you to place an order with us for the Products described on this Site (the “Order”) but we reserve the right to refuse to accept your Order. We may choose to exercise this right of refusal if, for example: you have provided incomplete or inaccurate details; there has been a change in pricing structure; or, we are unable to deliver the Products at the times required.
When you place an order to purchase a product from shop.oxfordoratory.org.uk, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product that is accepted by us when we send e-mail confirmation to you that we’ve dispatched that product to you (the “Dispatch Confirmation e-mail”). That acceptance will be complete at the time we send the Dispatch Confirmation e-mail to you. Any products on the same order which we have not confirmed in a dispatch confirmation e-mail to have been dispatched do not form part of that contract.
You must pay for the Products by credit or debit card at the time you place the Order, at which time you will be notified of the current Price. Your card will only be debited once we have accepted the Order.
If we accept the Order, we will notify acceptance to you by online electronic means (“Confirmation”) to the email address you have provided us on ordering. A legally binding contract will be formed between us at the time of sending the Confirmation.
We reserve the right to deliver goods up to 28 days after date of order although we expect to process orders within 1-3 business days.
Any information you provide to us will be governed by our Privacy Policy. Any information you provide to third parties will be governed by their terms and conditions.
These terms shall be governed by and construed in accordance with the law of England, and the English Courts shall have exclusive jurisdiction to deal with any dispute that may arise out of them.
We will make reasonable efforts to present accurate information but we cannot guarantee the price or our ability to supply any particular Product. Prices are subject to change without notice.
Customs Charges
If you order products from our website for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. UK VAT is not charged on orders shipped to geographical areas outside of the UK.
Use of Site
We reserve the right to refuse service, terminate accounts, and/or cancel transactions at our discretion if we believe that customer conduct is in violation or breach of any applicable law or these Terms, or is harmful to our interests. This does not affect your statutory rights as a consumer. Contracts are established at the time of dispatch.
Damaged or faulty goods
We do everything we can to ensure your order will arrive with you correctly and in good condition, however if there is an issue with the goods that arrive, i.e. damaged or incorrect items, we will offer to refund or replace the products if we are at fault.
In the event that we ask you to return faulty items, we will reimburse the cost of ordinary postage.
Any claim for shortages/defects of the goods delivered must be made within 14 days of delivery stating your order number and the nature of the shortages/defects. If you fail to notify us in this time, you will be deemed to have accepted the goods.
Non Delivery
In the event that a dispatched item is delayed or assumed lost in transit we cannot offer to replace or refund until:
10 business days after dispatch if the item was sent via ‘standard’ post within the UK
5 business days after dispatch if the item was sent via ‘tracked’ post within UK
25 business days after dispatch if the item was sent via ‘standard’ post to the EU and Europe
25 business days after dispatch if the item was sent via ‘standard’ or ‘tracked’ post to the Rest of the World
The Oxford Oratory shall have no liability to you unless you let us know within a total of 40 days of the date on which the goods were dispatched to you.
If you notify us of a problem under this condition, our only obligation will be, at our option, to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective, or to refund to you the amount paid by you for the goods in question to the original method of payment.
Right to withdraw or cancel
You have the right to withdraw from this contract before your order has been dispatched without giving any reason. In this case, you will receive a full refund, including any additional postage costs.
You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right to cancel, you must inform us by e-mailing shop@oxfordoratory.org.uk of your decision to cancel this contract by a clear statement. You may use the attached model cancellation form, but it is not obligatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than-
(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
Please return the item in its original condition and get proof of return postage. The Oxford Oratory is unable to accept responsibility for items lost or damaged in the post. Please note, the customer is responsible for the cost of returning the items, unless incorrect or faulty.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
